Terms of Service

1. Acceptance of Terms

By accessing or using Scry Pro ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

When you create an account and accept these Terms through the signup flow, you also agree to receive product and newsletter emails from Scry Pro. You can unsubscribe from marketing emails at any time without affecting transactional service emails.

2. Description of Service

Scry Pro provides daily fantasy sports (DFS) analytics and projections for the following sports: NFL, NBA, MLB, NHL, Golf (PGA), NASCAR, and MMA. The Service includes but is not limited to player projections, contest analysis, competitor profiling, slate review, backtesting, and AI-powered insights.

Important: Scry Pro is an analytics and information service only. We do not operate any gambling or fantasy sports contests. You are solely responsible for your participation in any DFS contests on third-party platforms (such as DraftKings or FanDuel).

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use the Service. By using Scry Pro, you represent and warrant that you meet this age requirement.

You are responsible for ensuring that your use of the Service complies with all laws, rules, and regulations applicable to you in your jurisdiction, including any restrictions on daily fantasy sports.

4. Subscription and Payment

Scry Pro offers multiple subscription tiers: Free, Pro ($29/month), and All-Access ($59/month). By subscribing to a paid plan, you agree to:

• Pay the applicable subscription fees at the current rate
• Provide accurate and complete billing information
• Authorize recurring monthly charges until you cancel
• Accept that prices may change with reasonable notice (30 days)

Subscription fees are charged at the beginning of each billing period through our payment processor, Stripe. You may cancel your subscription at any time through your account settings, and cancellation will take effect at the end of your current billing period. You will retain access to paid features until your current billing period ends.

5. Refund Policy

Given the nature of digital services and immediate access to premium features, all subscription payments are generally non-refundable. However, we may consider refunds in the following circumstances:

• Technical Issues: If you experience persistent technical problems that prevent you from using paid features, contact us within 7 days of your payment
• Duplicate Charges: Accidental duplicate payments will be refunded in full
• First-Time Subscribers: New subscribers may request a refund within 48 hours if the Service does not meet expectations
• Terms Changes: If we make material changes to these Terms that you do not agree to, you may request a prorated refund for the unused portion of your current billing period

How to Request a Refund

To request a refund, email [email protected] with:

• Your account email address
• The reason for your refund request
• Any relevant details (e.g., error messages for technical issues)

Refund Processing

Approved refunds will be processed within 5-10 business days and returned to your original payment method. Depending on your bank or card issuer, it may take additional time for the refund to appear in your account.

Note: Refund decisions are made at our sole discretion. We reserve the right to deny refund requests that appear fraudulent or that abuse this policy.

6. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not share your account credentials with others (accounts are for individual use only)
• Not attempt to reverse-engineer, decompile, or copy the Service
• Not use automated tools, bots, or scripts to scrape or collect data from the Service
• Not resell, redistribute, or commercially exploit the projections or data
• Comply with all applicable laws regarding DFS participation in your jurisdiction
• Provide accurate information when creating your account

7. Discord Community

Scry Pro provides access to a Discord community for subscribers. By participating, you agree to:

• Follow the community guidelines and rules posted in the Discord server
• Treat other members with respect and refrain from harassment or hate speech
• Not share paid content or projections with non-subscribers
• Not spam, advertise, or promote competing services

Violation of community guidelines may result in removal from the Discord server and/or termination of your Scry Pro account without refund.

8. No Guarantee of Results

THE SERVICE DOES NOT GUARANTEE ANY SPECIFIC RESULTS OR WINNINGS.Our projections, analysis, and recommendations are based on statistical models and historical data, but actual outcomes in DFS contests are inherently unpredictable.

You acknowledge that:

• DFS involves financial risk, and you may lose money
• Past performance does not guarantee future results
• Projections are estimates and not guarantees of player performance
• Data may contain errors or be delayed; verify important information independently
• You should never wager more than you can afford to lose

We encourage responsible gaming practices. If you feel you may have a gambling problem, please visit the National Council on Problem Gambling at www.ncpgambling.org.

9. Intellectual Property

All content, features, and functionality of the Service, including but not limited to projections, algorithms, data analysis, competitor profiling data, and user interface, are owned by Scry Pro and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only. This license does not include the right to resell, redistribute, or commercially exploit any content or data from the Service.

10. Account Termination

We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe:

• Violates these Terms of Service
• Is harmful to other users, the Service, or third parties
• Involves fraudulent, abusive, or illegal activity
• Involves sharing account access or paid content with non-subscribers

You may delete your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease. If you wish to have your data anonymized, you may submit a data removal request.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCRY PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

THIS INCLUDES, WITHOUT LIMITATION, ANY LOSSES INCURRED FROM:

• Reliance on projections, analysis, or recommendations provided by the Service
• Participation in DFS contests based on information from the Service
• Service interruptions, delays, or errors
• Unauthorized access to your account

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Scry Pro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your participation in DFS contests
• Your violation of any third party rights

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after changes indicates acceptance of the new Terms.

If you do not agree to the updated Terms, you must stop using the Service and may request a prorated refund for any unused portion of your current subscription period.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scry Pro regarding the Service and supersede all prior agreements and understandings.
